No charges will be filed in a deadly shooting in Hendersonville after authorities and officials ruled the case as self defense.

A press release from the city of Hendersonville on Tuesday said after an extensive review of the evidence, and in consultation with the District Attorney’s Office, authorities determined the Nov. 24, 2023 shooting death of 30-year-old Elijah Edward Timmons III was a case of self defense. Therefore, murder charges will not be sought for the shooter.

“Whenever someone is shot and killed, it is a senseless death,” Hendersonville Police Chief Blair Myhand said in Tuesday's press release. “Even though no charges are being made at this time, we will not tolerate this kind of violence.”

Hendersonville police said officers were dispatched to Orchard Bar & Grill at Henderson Crossing in reference to a disturbance involving gunshots in the parking lot around 2:35 a.m. on Nov. 24. Officers found the victim, Timmons III, of Asheville, with a gunshot wound to the head in the parking lot. The preliminary investigation revealed that Timmons was engaged in an altercation with a suspect before he was fatally shot, a spokesperson for the city previously told News 13.

Police and deputies were on the scene most of the early morning, reopening the parking lot to the Henderson Crossing Plaza just before 7 a.m.
